RERA Uttar Pradesh – Developers in bout of disagreement with the government

The real estate developers in Uttar Pradesh disagreed with the government’s decision of closing the window for registering their real estate projects with the RERA after 31st July 2017.

The incident happened when the CM of Uttar Pradesh , Yogi Adityanath announced 26th July 2017 as the date of launch of the online portal for UP RERA. In his speech at a seminar organised by Confederation of Real Estate Developers Association of India, CM asked all the developers to register their projects that come under the ambit of the RERA as per the rules by 31st July 2017.

While addressing the realtors who came from various parts of the country, Yogi said that the government is bound to remove the ambiguities from the real estate sector and RERA is an initiative to do so. The developers must obey the RERA rules and help the government to protect the interest of home buyers, he added.

The home buyers are happy with this move by the government, but the developers are unhappy with the CM’s statement.

A real estate developer having numerous projects in NCR and Lucknow told the reporters that the government is not considering the difficulties that the developers are facing.

Registering the projects with the RERA within 4-5 days is not a child’s game. We have to understand the rules, consult our legal advisors, place all the documents together and have to manage the registration fee. This will require at least a month and anyhow if we carry out these processes hastily, the RERA will hold developers liable for any errors and will penalize us.

Another real estate developer from Nodia said that the government is only making developers liable for the delay in completing the projects. One of the main obstacles in project delay is the corrupt officials who do not pass the valid documents on time. He also alleged the state government of not taking strict actions against such officials.

Yogi Adityanath is the Chief Minister of Uttar Pradesh since 26th March 2017 but has not taken any major action to implement the UP RERA in almost four months. The government is now trying to make everything in-line at the last minute, said an owner of a real estate development firm in Allahabad.
