RERA may come into action in Karnataka by month-end

Adding many loops to delays in implementing the Real Estate (Regulation & development) Act (RERA) in Karnataka, the state government is finally ready with the rules and may notify it by June 30th, 2017.

Contradicting any confusion in implementing the RERA M Krishnappa, the state housing minister said that the final rules are ready and soon we will present it before the cabinet for rectifications and approval.

Earlier, property buyers in Karnataka alleged the state government for diluting the parent Act and drafting the rules in favour of developers. Buyers also called for a protest demanding quick implementation of the Act in the state and to include under-construction projects under the RERA norms. The opposition party also alleged the Congress-ruled state government for facilitating its MLAs who are in the real estate business.

According to an official working with the drafting committee, the cabinet will decide whether to include on-going projects which have not got the completion certificate or not the rest we all assure that there is no dilution in the Act notified by the Central government.

The Karnataka government published the draft rules for RERA Karnataka in October 2016 and invited stakeholders to give suggestions, but the Act is still not implemented in the state.

A group of home buyers has recently written a letter to Sonia Gandhi, the President of Indian National Congress, highlighting the delays in implementing the RERA in Karnataka.

The Central government asked all the states to notify the RERA by 1st May 2017, but only nine states and six union territories have notified the Act.

    On going projects - the Builder seems to have taken the completion certificate for the building in which we have booked a flat , all money due has been taken by them but delivery has not been given. Would such flats which have not been handed over would be considered as on-going - project or Completed as Karnataka is yet to notify RERA rules. Please clarify. Regards G.M.Joshi
