After counting days to get the benefits of the Real Estate (Regulation & development) Act the real estate buyers in Haryana can see a ray of hope after the Town and Country Planning (TCP) department announced to submit the report on the RERA draft rules to the state government.
The Central government asked all the states to notify their own version of the RERA by 1st June 2017 but most of the states failed to do so. When asked about the delay in implementing the Act, an official of TCP said that this is one of the major reforms in the real estate sector which will directly affect the economic growth of the state so, it was necessary to seek suggestions from both realtors and buyers . Now, we are ready with the reports and will submit the same to the cabinet.
According to the Act notified by the central government, all real estate projects including the older ones should come under the ambit of the RERA. As per the sources, all the real estate projects that have not received the completion certificate will come under the ambit of RERA Haryana . The authority will penalize the developers who will fail to register such projects. The new rules also contain an Anti-Discriminatory Clause which will prevent any discrimination that consumers have to deal with on the basis of gender, caste, ethnicity, sexual orientation or food habits.
The Principal Secretary of TCP, Arun Kumar Gupta said that we will consider all the suggestions and once the government incorporates the amendments, we may notify the Haryana RERA rules by July 1. Recently, Mr. Rao Inderjit Singh, Minister of state housing wrote a letter to Mr. Manohar Lal Khattar, the chief minister of Haryana asking him to revise the diluted rules of the Act.
The Central government notified the Real Estate (Regulation & development) Act on 1st May 2016. This Act will enhance the transparency and will infuse professionalism in the real estate sector of India.
I am also one of the victim of Builder. I have also apply for flat in Aarcity Regency Park, Sector 11A-17, Hisar and as per agrrement with builder Aarcity Builders Private Limited as on 12.10.2012 the aforesaid builder /developer company has to give me possession of flat with in 36 month of agreement and further with grace perios maximum upto 12.01.2016 but he fail to give me possession of flat and I have already paid more than 60 % of flat amount with in time without any default and now company has to pay me "Delayed possession charges" as per agreement @ Rs.5/- per sq feet per month which comes Rs.10470/- per month, after protest of other flat holder and give complaint in newspaper, police station and local concern office , he promise to start giving delayed possession charges cheques from 1 June-2017 but later on he again refused to pay, and now he tried to get certificate from "Builder Town and County Planning office" of partly completion certificate so that his project will be exclude from RERA-HARYANA, So I request to our C.M Sh. Manohar Lal Khattar Jee and Sh. Rao Inder Jeet Singh, Minister State Housing to check on any appliaction from Aarcity Regency Park, Hisar regarding partly completion certificate of project , which is now practically about 20% of comitment and same should be physicaly checked and blacklist such fake builder and same should be kept behind bar and penalised to look after of interest of customers.
yES Mr. Rameshwar dayal gera is correct.Also i had problem with gurugram builders possesion is delayed for two years again after full payment is rceived since last one year ,structure is ready but inerior fining is stopped since last one year.Ag ain slaes office takes payment and divert it to estate office to get physical possesion,why that should be there responsibilty to get the work done as that is thre own people than why agreemnt says flat possion will be given as per agreement,
we want central govt RERA,Mr Khatter should follow UP RERA And Why not?Builder like BPTP has looted the home buyers taken95% of the cost in projecy llike Arena last 8 years no work last 5 years,shameless .Mr Modi tell Mr Khatter to help the home buyers in distress
