The government of Andhra Pradesh notified the Real Estate (Regulation & development) Act (RERA) on March 27th, 2017. The AP RERA rules are almost in line with the rules notified by the Central Government but lacks clarity on the fee for various services.
As per the section which contains the fee for the registration of a real estate project “the application for the registration of a real estate project shall be submitted at the office of the Authority along with the Registration Fees as prescribed from time to time.” RERA notification for states such as Maharashtra clearly specifies the fee for the registration of a real estate project as “Rs. 10 per square meter or a minimum of Rs. 50,000 and maximum up to Rs. 10,000,00”.
Although the AP RERA notification has specified the fee for Fee for filing complaint with the Regulatory Authority, Adjudicating Officer and fee for appealing with the Appellate Tribunal, it lacks clarity on the fee for application for the time extension of real estate project, fee for withdrawing the application for registration of the a project, agent registration fee and the fee for the renewal of the registration of a real estate agent.
